George The Third, by the Grace of God of the United Kingdom of Great Britain and Ireland, King Defender of the Faith……. To all to whom these Presents shall come…… GREETING: know Ye, that We of Our special grace, certain knowledge, and mere motion have Given and Granted and by these presents do GIVE and GRANT unto James Askin of the Township of Sandwich in the County of Essex Western District Gentleman his, heirs and assigns forever; All that parcel or tract of land situate in the Township of Maidstone in the County of Essex in the Western District in our said Province, containing by admeasurement Six hundred acres on Lake St. Clair between Belle River and River aux - Lot Number Twelve in the Second concession and Lot Number Eleven in the Third Concession of the said Township of Maidstone.
Together with all the woods and water there on lying and being under the reservations, limitations, and conditions hereinafter expressed: which laid six hundred acres of land are butted and bounded or may be otherwise known as follows: that is to lay commencing in front when Lake St. Clair at the North West angle of the said Lot Number Two; then South Ninety for Chains more or less to the allowance for Road in the rear of the said Lot; then East twenty two chains, twenty three links more or less to the land between lots Number two and one, the North to Lake St. Clair; then Western along the water edge to the place of beginning. Also commencing in front of the said Second and Third concessions at the North East angle of each of the said lots number Eleven and Twelve respectively, then South thirty chains more or less to the Southern Boundary of each lot. Then west 66 chains 80 links more or less to the allowance for Road of the 6 concessions; Then North 30 chains more or less to the Northern Boundary of each lot. Then East 66 chains, 80 links more or less to the plan of the beginning in each lot.
TO HAVE AND TO HOLD the said parcel or trace of Land hereby given and granted to him the said James Askin His heirs and assigns for ever: having neverthesis to Us, our heirs and successors, all Mines of Gold, silver, Copper, Tin, Lead, Iron and Coal that shall or may be hereafter found on my part of the said parcel or tract of land hereby given and granted as aforesaid, and having and referring to Us, our heires and successors all white Pine Trees, that shall, or may now, or hereafter grow, or be growing, or be growing, on any part of the said parcel or tract of land thereby granted as aforesaid.
Provided always, that no part of then parcel or tract of land, hereby given and granted to the said James Askin and his heirs, be within any reservation heretofore made, and marked for Us, our heirs and successors, by our Surveyor General Woods, or his lawful deputy, in which café this our Grant for such past of the land hereby give and his heirs for ever as aforesaid, and which shall upon a survey thereof being unade, be found within any such reservation, shall be null and void, and of none effect, any thing herein contained to the contrary notwithstanding. His heirs or assigns; shall and do within three years erect and build, or provided alto, that said James Askin cause to be erected and built, in and upon same part of the said parcel or trace of land a good and sufficient dwelling house, he the said James Askin or his assigns not having built, or not being in his or their own right lawfully proceeded of an house in our said Province and therein, or cause some person to be therein resident forfor and during the space for one year, thence next ensuring the building of the same.
Provided into that if at any time or times hereafter, the land so hereby given and granted to the said James Askin and his heirs shall come into the possession and senate of any person or persons whomsoever, either by virtue of any deed of sale, conveyance, assessment, or exchange, or by gift, inheritance, descent, devise, or marriage, such persons or persons shall within twelve months next as or his, her, or their entity into, and possession of the same, take, take the oaths prescribed by law, before some one of the Magistrates of our said Province; and a certificate of such oaths having been so take shall cause to be recorded in the Secretary’s office of the said Province.
In Default, of all, or any of which conditions, limitations, and restrictions, this said Grant, and everything herein contained, shall be, and We hereby declare the same to be null and void to all intents and purposes whatsoever, and the land hereby granted, and every part and parcel thereof, shall revert to, and become veiled in Us, our heirs and successors, in like manner as if the same had never been granted; anything herein contained to the contrary in and wise notwithstanding.
AND WHEREAS by an Act of the Parliament of Great Britain, passed in the Thirty-fifth year of his Majesty’s reign, instituted, “An Act to repeal certain parts of an Act passed in the Fourteenth year of his Majesty’s reign, “intituled,” “An Act for making more essential provision for the Government of the Province Quebec in North America and to make further province for the Government of the Said Province,” it is declared, “That no “Grant of Lords hereafter made, shall be valid or efficient, unless the same shall contain a specification of the lands to be allotted and appropriated solely to the maintenance of a Protestant Clergy within the said Province,” in respect of the lands to the thereby granted: Now know ye, that We have caused an allotment or appropriation of Twenty-eight acres and 4/7 to be made in Lot number 17 in the 6th concession west of Belle River in the said Township of Maidstone and 57 acres and 1/7 to be made in Lot 13 in the 7th concession west of Belle River, in the said Township of Maidstone
